Americans with Disabilities Act and AIDS
AIDS is often a terminal condition, and millions of people have died from the disease. With medical advancements, however, some AIDS patients have been able to manage their disease as a long-term condition and have an extended life expectancy. Under the Americans with Disabilities Act (ADA) of 1990, individuals who are HIV positive or have developed AIDS are protected from workplace discrimination. An employer cannot deny a person a job or promotion, or fire an employee, simply because the individual has AIDS.
The ADA mandates that employees with AIDS be treated like all other employees in terms of hiring, promotion, firing, benefits, and retirement. Individuals who have HIV but have not yet developed AIDS and do not show any outward signs of the disease are still covered under the ADA. If an employer discriminates against an employee because of his or her condition, he or she can be held accountable for disregarding the federal protections afforded to employees with AIDS under the ADA.
