The amendment makes it illegal to take preventative or retaliatory action against those asserting their freedoms of religion, speech, assembly, and petitioning. If you as a public employee speak out against unfair workplace practices, then federal law prohibits your employer from taking aggressive steps against you in retaliation.

What is the First Amendment?
The First Amendment states that:
“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”
Under this federal law, all government agencies are prohibited from retaliating against employees who express their freedoms of speech in the workplace. Employers are not allowed to strike back against workers who publicly announce or discuss unfair or unsafe work environments. However, the First Amendment does not cover private companies.
